THE PRESIDENT OF THE REPUBLIC OF INDONESIA

Considering:

a) that in order to prevent and combat criminal acts of terrorism, the President of the Republic of Indonesia has issued the Government Regulation in Lieu of Legislation No.1, 2002 on Combating Criminal Acts of Terrorism;

b) that the bombing incident which took place in Bali on 12 October 2002 gave rise to a widespread atmosphere of terror or fear in people and caused the loss of life and property of others;

c) that based on the considerations set out in a) and b), it is necessary to enact the Government Regulation in Lieu of Legislation about the Government Regulation in Lieu of Legislation No.1, 2002 on Combating Criminal Acts of Terrorism in Relation to the Bombing Incident in Bali on 12 October 2002;

Recalling:

1. Article 22(1) in the 1945 Constitution as amended through the Fourth Amendment to the 1945 Constitution;

2. The Government Regulation in Lieu of Legislation No.1, 2002 on Combating Criminal Acts of Terrorism (Paper of the Republic of Indonesia 2002 No.106, Supplementary State Paper No.4232);

RESOLVES:

To establish:

THE GOVERNMENT REGULATION IN LIEU OF LEGISLATION ON ENACTING GOVERNMENT REGULATION IN LIEU OF LEGISLATION NUMBER 1, 2002 ON COMBATING CRIMINAL ACTS OF TERRORISM, IN RELATION TO THE BOMBING IN BALI ON 12 OCTOBER 2002.

Article 1
The provisions in the Government Regulation in Lieu of Legislation No.1, 2002 on Combating Criminal Acts of Terrorism, are deemed to take effect in relation to the bombing incident which occurred in Bali on 12 October 2002.

Article 2
This Government Regulation in Lieu of Legislation takes effect on the day it is enacted.

In order that all people comprehend it, orders the enactment of this Government Regulation in Lieu of Legislation through its lodging in the State Papers of the Republic of Indonesia.

IN RELATION TO THE BOMBING INCIDENT IN BALI
ON 12 OCTOBER 2002

GENERAL

In accordance with the Preamble of the 1945 Constitution, the Republic of Indonesia is a unitary state that is based upon the rule of law and holds the duty and responsibility to maintain a safe, peaceful and prosperous existence, and also involves itself actively in maintaining world peace. To reach these goals, the Government must protect and maintain its sovereignty and protect each of its citizens from every threat or destructive act from both inside the country and from overseas.

Terrorism is an crime against humanity and civilisation and forms one of the serious threats facing the sovereignty of every nation, because terrorism already forms a crime of an international nature which has given rise to danger against security and world peace, as well as harming social prosperity, therefore it is necessary to carry out a planned and continuous elimination of terrorism so that the human rights of many people can be protected and revered.

In the framework of preventing and combating criminal acts of terrorism, the President of the Republic of Indonesia has issued the Government Regulation in Lieu of Legislation No.1, 2002 on Combating Criminal Acts of Terrorism.

In relation to the occurrence of criminal acts of terrorism in Bali on 12 October 2002 as well as the pressing need to overcome this problem, the President of the Republic of Indonesia referring to Article 22(1) of the 1945 Constitution as amended by the Fourth Amendment to the 1945 Constitution, has found it necessary to issue the Government Regulation in Lieu of Legislation No.1, 2002 on Combating Criminal Acts of Terrorism, in Relation to the Bombing Incident in Bali on 12 October 2002.
